Terms and conditions for Pampa Boats boat rental service in Cambrils, Tarragona.

Service Provider Identity

The provider of boat rental services is Pampa Boats, based at the Port of Cambrils, Tarragona, Spain. Contact: hola@pampaboats.com. Pampa Boats operates in compliance with applicable Spanish nautical charter regulations.

Service Description

Pampa Boats offers recreational boat rental services with and without a licence. Available vessels are: La Pampa (Bond Yachts 13, 4m, no licence required, up to 5 passengers) and El Gaucho (Quicksilver 505 Commander, 5m, with or without skipper, up to 5 passengers). The service includes the vessel rental, fuel for standard navigation in the Cambrils area, certified safety equipment, and the items listed in each vessel's product description.

Bookings and Payment

Bookings are made exclusively online through the Pampa Boats website. Payment is made by credit or debit card via the Stripe secure payment platform, which complies with PCI DSS standards and EU SCA/3DS2 regulations. The full booking amount must be paid at the time of confirmation. Once payment is complete, the customer will receive a confirmation email with all trip details.

Cancellations and Refunds

Customers may cancel their booking free of charge up to 24 hours before the scheduled departure time. Cancellations made less than 24 hours before departure are non-refundable. No-shows (failure to appear at the meeting point without prior notice) are also non-refundable. If Pampa Boats cancels the trip due to adverse weather conditions or other force majeure events, the customer is entitled to a full refund of the amount paid, or to reschedule the trip to a mutually agreed date, at their choice.

Passenger Responsibilities

Passengers agree to follow all safety instructions provided by Pampa Boats before departure and, in the case of El Gaucho, the skipper's instructions throughout the trip. Wearing a life jacket is mandatory when instructed by the skipper or operator. Reckless behaviour, excessive alcohol consumption on board, and any activities that may endanger crew safety or the marine environment are strictly prohibited. Passengers must respect marine flora and fauna and comply with applicable navigation rules.

Limitation of Liability

All Pampa Boats vessels are insured in accordance with Spanish maritime law, covering hull and third-party liability. Pampa Boats is not liable for the loss, theft or damage of passengers' personal belongings on board. In cases of force majeure (extreme weather, unforeseeable mechanical failures, or causes beyond the operator's control), Pampa Boats is released from liability for non-provision or interruption of the service, without prejudice to the customer's right to a refund or rescheduling as outlined in the cancellations section.

Governing Law and Jurisdiction

These terms and conditions are governed by Spanish law. For the resolution of any dispute arising from the contracting or provision of the service, the parties submit to the courts of Tarragona, Catalonia, Spain, expressly waiving any other jurisdiction that may apply to them.
